Paris has set out, in these General Terms and Conditions of Sale, the terms and conditions of sale of its products applicable to Customer orders placed through its website: www.alixdreynis.com

Preamble

Alix D. Reynis manufactures and sells porcelain objects and vermeil jewelry worldwide under the “AlixD.Reynis” brand.

The list of products offered for sale online by Alix D. Reynis is available on this website.

The Customer and Alix D. Reynis agree that their commercial relationship shall be governed exclusively by these Terms and Conditions of Sale.

Alix D. Reynis reserves the right to amend these Terms and Conditions of Sale at any time by publishing a new version on the website.

The Terms and Conditions of Sale applicable to each order are those in force on the date the order is confirmed on the website.

Article 1 – Purpose

These Terms and Conditions of Sale define the rights and obligations of Alix D. Reynis and the Customer in connection with the online sale of products offered on this website.

Article 2. – General Provisions

These General Terms and Conditions of Sale apply to all sales of products made through the seller’s website and form an integral part of the contract between the customer and the seller. They are available on the seller’s website at: www.alixdreynis.com. The seller ensures that they are accepted clearly and without reservation by means of a checkbox and a confirmation click for each transaction. Accordingly, the Customer declares that they have read all of these General Terms and Conditions of Sale and, where applicable, any Special Terms and Conditions of Sale relating to a product or service, and accepts them without restriction or reservation.
The Customer acknowledges having had access to the advice and information needed to ensure that the offer meets their needs. The Customer declares that they are legally able to place orders under French law, or that they are duly authorized to represent the individual or legal entity on whose behalf they are acting. Unless proven otherwise, the information recorded by the seller constitutes proof of all transaction details. These General Terms and Conditions of Sale apply to Orders placed for delivery in France or abroad.

Article 3. - Entry into Force and Duration

These General Terms and Conditions of Sale apply to the parties from the date the order is confirmed. These General Terms and Conditions of Sale apply for the time needed to supply the products, until all warranties and obligations owed by Alix D. Reynis have expired.

Article 4. - Ordering Products and Services and Steps to Complete an Online Sale

To place an order, the Customer must follow these steps:

  1. Enter the Site address or access the Site through a link.
  2. Follow the instructions on the Site, in particular the instructions for creating a customer account.
  3. Fill in the order form.
  4. Check the order details and, if necessary, identify and correct any errors.
  5. Read and accept the Alix D. Reynis General Terms and Conditions of Sale, then confirm the order and the total amount due.
  6. Follow the instructions of the online payment server to pay the total amount shown.

Unless the server is unavailable, the Customer may pay for their order once it has been finally confirmed on the Site. The Customer will then receive an email confirming payment of the order, together with an acknowledgment of receipt confirming the order. The products ordered will be delivered to the address provided by the Customer. To ensure the order is properly fulfilled, and in accordance with Article 1316-1 of the French Civil Code, the Customer agrees to provide all information needed to verify their identity. All orders placed on the Site are intended solely for the Customer’s personal use. Accordingly, the Customer or the recipient of the products may not resell all or part of the products ordered.
While completing the order steps described above, the Customer agrees to comply with these General Terms and Conditions of Sale. In accordance with Article L. 122-1 of the French Consumer Code, Alix D. Reynis reserves the right to refuse any order that appears abnormal (particularly in view of the quantities ordered), that is placed in bad faith, or that is unacceptable for any other reason, in particular where there is a dispute with the Customer concerning payment for a previous order.

Article 5. - Product Prices and Validity Conditions

The price of the products sold on the Site is shown for each item and each reference, barring typographical errors. These prices include the VAT applicable on the day of the order but do not include shipping costs, which are charged in addition as shown to the Customer when confirming their order. For any order shipped outside the European Union and/or to the French overseas departments and territories (DOM-TOM), the price is automatically calculated excluding tax on the invoice. Customs duties, other local taxes, import duties or state taxes may be required in some cases. These duties and charges are outside the seller’s control. They are payable by the customer and are the customer’s responsibility. The seller therefore invites the customer to check these matters with the relevant local authorities.

When the order is confirmed, the price to be paid is the total amount of the order. Product offers and prices are valid as long as they are available on the Site, while stocks last. Information about product availability may therefore be provided to the Customer when the order is placed. Errors or changes may occasionally occur, particularly when several customers order the same item at the same time. If an item becomes unavailable after the Customer has confirmed the order, Alix D. Reynis will inform the Customer by email as soon as possible and will offer either to replace it with another item shown on the Site or to cancel the order. If the Customer chooses to cancel the order, the refund will be made no later than 30 days after payment if the Customer’s bank account has been charged.

Alix D. Reynis reserves the right to change the product lists and/or prices on the Site at any time and without notice. The prices in effect at the time of the order are those accepted by the Customer when confirming it. The Customer is hereby informed that product illustrations, colors, photographs and descriptions are for guidance only and are not contractually binding. Alix D. Reynis cannot be held liable for any error or inaccuracy. Any telecommunication costs incurred to access the site are borne solely by the Customer. The validity period of product offers and prices is determined when the Site is updated.

Article 6. - Payment Terms

Payment is due immediately when the order is placed. The customer will pay by credit or debit card. The order amount may only be paid using one of the following payment methods: VISA, MASTERCARD, AMERICAN EXPRESS, APPLE PAY, PAYPAL and ALMA (interest-free payment in 3 installments for purchases of €200 or more). Payment by check or bank transfer is not accepted. The Customer’s card is charged when the order is shipped, after the card details have been verified and authorization has been received from the issuer of the card used by the Customer. Once the customer has initiated payment, the transaction is charged immediately after this information has been verified.

In accordance with Article L.132-2 of the French Monetary and Financial Code, a commitment to pay by card is irrevocable once it has been activated. By providing their card details, the Customer authorizes Alix D. Reynis to charge their card for the total amount of the order. The Customer therefore authorizes their bank in advance to debit their account on the basis of the records or statements sent through the payment module, even without invoices signed by the cardholder. To this end, the Customer confirms that they are the holder of the card to be charged and that the name on the card is their own. The Customer provides the sixteen-digit card number and expiration date and, where required, the security code. If the total amount due cannot be charged, the Customer will be asked to restart the payment process. If the charge still cannot be made, the online sale will automatically be terminated and the order canceled. Any non-payment resulting from fraudulent use of a card will lead to the details associated with that non-payment being recorded in a payment incident file managed by a third party. Any false declaration or irregularity may also result in legal action.

Article 7. - Order Delivery

Products are delivered to the shipping address provided when the order was placed. The customer is solely responsible for any failed delivery due to a missing or incorrect address. Shipping costs depend on the amount and type of order. In all cases, these costs are shown to the Customer before the order is confirmed. Subject to the availability of the products selected, the delivery method is shown to the Customer throughout the order confirmation and payment process. The delivery time will depend on the final delivery method. Delivery times run from the date Alix D. Reynis confirms the order and are based on average order preparation and shipping times. Delivery times are given for guidance only and are deemed to have been met by Alix D. Reynis once the order has first been presented at the address provided by the Customer within the timeframe indicated to them. In the event of late delivery, the customer may terminate the contract under the conditions set out in Article L138-2 of the French Consumer Code. The seller will then refund the product under the conditions of Article L138-3 of the French Consumer Code. The seller provides a point of contact, shown in the order confirmation email, so the customer can track their order.

The seller reminds the customer that the risk of loss of or damage to the products passes to the customer when they take physical possession of their order. It is therefore the customer’s responsibility to notify the carrier of any reservations about the product delivered. The Customer must check the condition of the packaging and the items on delivery. It is the Customer’s responsibility to make any reservations and claims they consider necessary, or to refuse the package, particularly if it is clearly damaged on delivery, and to do so before opening it (for example, if you hear the sound of something broken inside). These detailed reservations and claims must be given to the delivery person and also sent to the carrier by registered letter with acknowledgment of receipt within three business days, excluding public holidays, following the date the products were delivered.

In all cases, it is important to state the reasons clearly. A reservation such as “subject to opening the package” has no value, whereas a reservation such as “package badly damaged, top left corner crushed, taped” is accepted. The Customer must also send a copy of this letter to Alix D. Reynis. Failure to make a claim within the period stated above extinguishes any right of action against the carrier, in accordance with Article L. 133-3 of the French Commercial Code. If the package is in good condition but the product is found to be damaged when opened, the Customer must return it to us for inspection under the conditions below, stating the reason for the claim on the return slip. The Customer must make sure that the products delivered to them match the order.

If the products do not conform in type or quality to the specifications shown on the packing slip, the Customer must return the products, complete and in their original packaging, together with the return form, to the following address:

Mérigous
Alix D. Reynis
3 rue Marthe Dutheil
87220 Feytiat
FRANCE

within seven (7) calendar days of the date the Customer received the order. The Customer is responsible for keeping proof of this return, which means the items must be returned by Colissimo or by any other method that provides a verifiable date. The costs and risks of the return remain the Customer’s responsibility.

Any claim concerning a package shown as “delivered” in the tracking information but which the customer states they have not received must be made within 3 business days of the delivery date shown. After this period, no investigation or compensation can be guaranteed.

For international deliveries, customs duties or import taxes may apply depending on the regulations of the destination country. These charges are payable by the customer and are not included in the product prices or shipping costs. The customer is responsible for finding out about any taxes or charges related to importing goods into their country, and for cooperating with customs or the carrier (e.g. UPS) if they make contact regarding payment of the charges required for delivery. If the customer refuses to pay customs charges, fails to respond to requests from customs or the carrier, or fails in any other way that results in the package being abandoned, returned or destroyed by customs or the carrier, Alix D. Reynis cannot be held liable. No refund, replacement or reshipment will be made in such cases.

Article 8. - Right of Withdrawal

In accordance with Article L.121-20 of the French Consumer Code, “the consumer  has a period of fourteen clear days to exercise their right of withdrawal without having to give reasons or pay penalties, except, where applicable, for return costs.” “The period mentioned in the previous paragraph runs from receipt for goods or from acceptance of the offer for services.” The right of withdrawal may be exercised by contacting the seller by email at help@alixdreynis.com. If the right of withdrawal is exercised within the period stated above, only the price of the product(s) purchased will be refunded; return costs remain the customer’s responsibility. Products must be returned complete and in their original condition (packaging, labels, etc.) so that they can be resold as new. If possible, they should be accompanied by a copy of the proof of purchase and sent to:

Mérigous
Alix D. Reynis
3 rue Marthe Dutheil
87220 Feytiat
FRANCE

Article 9. – Complaints

Where applicable, the customer may submit any complaint by contacting the company using the following details: by email at help@alixdreynis.com or by mail:

Alix D. Reynis
22 rue Jacob
75006 Paris
FRANCE

Article 10. – Warranties

In accordance with the law, the seller provides a legal warranty of conformity and a warranty against hidden defects for its products. The seller will refund the customer for products that appear defective or do not match the order placed. Refund requests must be made by email to: help@alixdreynis.com. Items returned incomplete, damaged, deteriorated or soiled by the Customer cannot be exchanged and will be handed back immediately or returned by mail as soon as possible.

Article 11. - Intellectual Property Rights

The trademarks, domain names, products, images, videos, texts and, more generally, any information subject to intellectual property rights are and remain the exclusive property of the seller. These Terms and Conditions do not transfer any intellectual property rights. Any reproduction in whole or in part, modification or use of these assets  for any reason whatsoever is strictly prohibited.

Article 12. – Personal Data Protection

In accordance with the French Data Protection Act of January 6, 1978, you have the right to query, access, modify, object to and withdraw consent for the personal data concerning you.  By accepting these General Terms and Conditions of Sale, you consent to our collecting and using this data to perform this contract. By entering your email address on our site, you will receive emails containing information and promotional offers about products published by the seller. You can unsubscribe at any time. To do so, simply click the link at the end of our emails or contact us by registered letter  with acknowledgment of receipt.  We monitor traffic on our site and use tools such as Google Analytics for this purpose.

Article 13. - Force Majeure

Alix D. Reynis’s performance of its obligations under these General Terms and Conditions of Sale will be suspended in the event of an unforeseeable event or force majeure that hinders or delays such performance.

Article 14. - Invalidity and Amendment of the Contract

If any provision of this contract is held invalid, this invalidity will not affect the other provisions, which will remain in force between the parties. Any amendment to the contract is only valid if agreed in writing and signed by the parties.

Article 15. Limitation of Liability

Alix D. Reynis cannot be held liable for any damage resulting from use of the internet, including but not limited to data loss, intrusion, computer viruses, loss of connection, internet outages or other problems beyond its control. Alix D. Reynis reserves the right to suspend operation of the Site at any time.

Article 16. - No Waiver

The fact that Alix D. Reynis does not enforce any of the obligations set out in these General Terms and Conditions of Sale shall not be interpreted as a waiver of that obligation in the future.

Article 17. – Governing Law

These General Terms and Conditions of Sale are governed by French law. Any dispute arising from the formation, interpretation or performance of these General Terms and Conditions of Sale shall fall under the exclusive jurisdiction of the French courts, even in the case of multiple defendants or third-party claims.

Accordingly, the customer declares that they have read all of these General Terms and Conditions of Sale and, where applicable, any Special Terms and Conditions of Sale relating to a product or service, and accepts them without restriction or reservation.
