Alix D. Reynis has set out in these General Terms and Conditions of Sale the terms and conditions governing the sale of its products for Customer orders placed through its website: www.alixdreynis.com
Preamble
Alix D. Reynis designs, manufactures and sells porcelain objects and silver-gilt jewelry worldwide under the brand “Alix D. Reynis”.
The list of products offered for sale online by Alix D. Reynis can be viewed on this website.
The Customer and Alix D. Reynis agree that their business relationship shall be governed exclusively by these General Terms and Conditions of Sale.
Alix D. Reynis reserves the right to amend its General Terms and Conditions of Sale at any time by publishing a new version on the website.
The General Terms and Conditions of Sale applicable to each order are those in force on the date the order is confirmed on the website.
Article 1. – Purpose
The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of Alix D. Reynis and the Customer in connection with the online sale of the products offered on this website.
Article 2. – General provisions
These General Terms and Conditions of Sale apply to all sales of products made through the seller’s website and form an integral part of the contract between the customer and the seller. They can be viewed on the seller’s website at: www.alixdreynis.com. The seller ensures that they are accepted clearly and without reservation by means of a checkbox and a confirmation click for each transaction. The Customer therefore declares that they have read all of these General Terms and Conditions of Sale and, where applicable, any Special Terms and Conditions of Sale relating to a product or service, and accepts them without restriction or reservation.
The Customer acknowledges having had access to the advice and information needed to ensure that the offer meets their needs. The Customer declares that they are legally able to place orders under French law or to validly represent the natural or legal person on whose behalf they are acting. Unless proven otherwise, the information recorded by the seller constitutes proof of all transaction details. These General Terms and Conditions of Sale apply to Orders placed for delivery in France or abroad.
Article 3. – Entry into force and duration
These General Terms and Conditions of Sale apply to the parties from the date the order is confirmed. They remain applicable for as long as necessary to supply the products, until all warranties and obligations owed by Alix D. Reynis have expired.
Article 4. – Ordering Products and Services and steps to complete an online sale
To place an order, the Customer must follow the steps below:
- Enter the website address or access the website through a link.
- Follow the instructions on the website, in particular the instructions required to open a customer account.
- Fill in the order form.
- Check the order details and, where necessary, identify and correct any errors.
- Read the Alix D. Reynis General Terms and Conditions of Sale, accept them, then confirm the order and the total amount payable.
- Follow the instructions of the online payment server to pay the total amount shown.
Unless the server is unavailable, the Customer may pay for their order once it has been finally confirmed on the website. The Customer will then receive an email confirming payment of the order, together with an acknowledgment of receipt confirming the order. The products ordered will be delivered to the address provided by the customer. To ensure that the order is processed correctly, and in accordance with article 1316-1 of the French Civil Code, the customer agrees to provide all necessary proof of identity. All orders placed on the website are intended solely for the Customer’s personal use. Accordingly, the Customer or the recipient of the products shall not resell all or part of the products ordered.
When completing the order steps described above, the Customer agrees to comply with these General Terms and Conditions of Sale. In accordance with article L. 122-1 of the French Consumer Code, Alix D. Reynis reserves the right to refuse any order that appears abnormal (in particular with regard to the quantities ordered), that is placed in bad faith or that is inadmissible for any other reason, in particular where there is a dispute with the Customer concerning payment for a previous order.
Article 5. – Product prices and validity
The price of the products sold on the website is shown for each item and each reference, barring typographical errors. These prices include the VAT applicable on the day of the order but do not include shipping costs, which will be charged in addition as indicated to the Customer when the order is confirmed. For any order shipped outside the European Union and/or to the French overseas departments and territories (DOM-TOM), the price is automatically calculated excluding tax on the invoice. Customs duties or other local taxes, import duties or state taxes may be charged in certain cases. These duties and amounts are outside the seller’s control. They are payable by the customer and are the customer’s responsibility. The seller therefore invites the customer to check these matters with the relevant local authorities.
When the order is confirmed, the price to be paid is the total amount of the order. Product offers and prices are valid as long as they are available on the website, while stocks last. Information on product availability may therefore be provided to the Customer when the order is placed. Errors or changes may occasionally occur, in particular when several customers order the same item at the same time. If an item becomes unavailable after the Customer has confirmed the order, Alix D. Reynis will inform the Customer by email as soon as possible and offer either to order another item shown on the website as a replacement or to cancel the order. If the Customer chooses to cancel the order, the refund will be made no later than 30 days after payment if the customer’s bank account has been debited.
Alix D. Reynis reserves the right to change the product lists and/or prices shown on the website at any time and without notice, it being specified that the prices in force at the time of the order are those accepted by the Customer when confirming it. The Customer is duly informed that the illustrations, colors, photographs and product descriptions are for information only and are not contractually binding. Alix D. Reynis cannot be held liable for any error or inaccuracy. Telecommunication costs related to accessing the website are borne exclusively by the Customer. The period of validity of product offers and prices is determined when the website is updated.
Article 6. – Payment terms
Payment is due immediately when the order is placed. The customer will pay by bank card. Payment of the order amount must be made exclusively by one of the following payment methods: VISA, MASTERCARD, AMERICAN EXPRESS, APPLE PAY, PAYPAL and ALMA (interest-free payment in 3 installments for purchases of €200 or more). Payments by check and bank transfer are not accepted. The transaction is charged to the Customer’s bank card at the time of shipment, after the card details have been verified and authorization to debit has been received from the company that issued the bank card used by the Customer. Once the customer has initiated payment, the transaction is debited immediately after this information has been verified.
In accordance with article L.132-2 of the French Monetary and Financial Code, the commitment to pay by card is irrevocable once it has been activated. By providing their bank card details, the Customer authorizes Alix D. Reynis to debit their bank card for the total amount of the order. The Customer therefore authorizes their bank in advance to debit their account on the basis of the records or statements transmitted via the payment module, even in the absence of invoices signed by the cardholder. To this end, the Customer confirms that they are the holder of the bank card to be debited and that the name on the card is their own. The Customer provides the sixteen-digit number and expiry date of their bank card and, where required, the security code. If it is not possible to debit the total amount due, the Customer will be invited to repeat the payment process. If the debit still cannot be made, the online sale will be automatically and immediately canceled and the order will be voided. Any payment default resulting from fraudulent use of a bank card will lead to the details associated with that default being recorded in a payment incident file managed by a third-party organization. Any irregular declaration or anomaly may also give rise to legal proceedings.
Article 7. – Delivery of the order
Products are delivered to the delivery address provided when the order was placed. The customer is solely responsible for any failed delivery resulting from a missing or incorrect address. Shipping costs depend on the amount and nature of the order. In any event, the amount of these costs is shown to the Customer before the order is confirmed. Subject to the availability of the products chosen, the delivery method is specified to the Customer throughout the order confirmation and payment process. The delivery time will depend on the final delivery method. Delivery times run from the date on which Alix D. Reynis confirms the order, based on average order preparation and shipping times. Delivery times are given for information only and are deemed to have been met by Alix D. Reynis once the order has first been presented at the address provided by the Customer within the time frame indicated. In the event of late delivery, the customer may terminate the contract under the conditions set out in article L138-2 of the French Consumer Code. The seller will then refund the product under the conditions set out in article L138-3 of the French Consumer Code. The seller provides a point of contact, shown in the order confirmation email, so that the order can be tracked.
The seller reminds the customer that the risk of loss of or damage to the products passes to the customer as soon as they take physical possession of their order. It is therefore the customer’s responsibility to notify the carrier of any reservations regarding the product delivered. The Customer must check the condition of the packaging and the items upon delivery. It is the Customer’s responsibility to express any reservations and complaints they consider necessary, or even to refuse the parcel, in particular where the parcel is clearly damaged on delivery, before opening it (for example, if you hear the sound of something broken inside). Such detailed reservations and complaints must be given to the delivery person and also sent to the carrier by registered letter with acknowledgment of receipt within three working days, excluding public holidays, following the date the products were delivered.
In all cases, it is important to state the reasons clearly, bearing in mind that a reservation such as “subject to opening the parcel” has no value, whereas a reservation such as “parcel badly damaged, top left corner crushed, taped up” is an accepted reservation. The Customer must also send a copy of this letter to Alix D. Reynis. Failure to complain within the above time limit extinguishes any claim against the carrier, in accordance with article L. 133-3 of the French Commercial Code. If the parcel is in good condition but the product is damaged when opened, the Customer must return it to us under the conditions below for inspection, stating the reason for the complaint on the return slip. The Customer must check that the products delivered correspond to the order.
If the products do not conform in nature or quality to the specifications stated on the packing slip, the Customer must return the products, complete and in their original packaging, together with the return form, to the following address:
Mérigous
Alix D. Reynis
3 rue Marthe Dutheil
87220 Feytiat
FRANCE
within seven (7) calendar days of the date on which the Customer received the order. The Customer is responsible for keeping proof of this return, which means that items must be returned by Colissimo or by any other means providing a verifiable date, with return costs and risks remaining the Customer’s responsibility.
Any claim concerning a parcel shown as “delivered” in the tracking but which the customer states they have not received must be made within 3 working days of the delivery date shown. After this period, no investigation or compensation can be guaranteed.
For international deliveries, customs duties or import taxes may apply depending on the regulations of the destination country. These costs are payable by the customer and are not included in the price of the products or in the shipping costs. It is the customer’s responsibility to find out about any taxes or fees related to importing goods into their country, and to cooperate with the customs services or the carrier (e.g. UPS) if they make contact regarding payment of the fees required for delivery. If the customer refuses to pay customs duties, fails to respond to requests from customs or the carrier, or fails in any other way that leads to the parcel being abandoned, returned or destroyed by the customs authorities or the carrier, Alix D. Reynis cannot be held liable. No refund, replacement or reshipment of the parcel will be made in such cases.
Article 8. – Right of withdrawal
In accordance with article L.121-20 of the French Consumer Code, “the consumer has a period of fourteen clear days in which to exercise their right of withdrawal without having to give reasons or pay penalties, with the exception, where applicable, of return costs”. “The period mentioned in the previous paragraph runs from receipt of the goods or from acceptance of the offer for services.” The right of withdrawal may be exercised by contacting the seller by email at help@alixdreynis.com. If the right of withdrawal is exercised within the above period, only the price of the product(s) purchased will be refunded; return costs remain the customer’s responsibility. Products must be returned in their original condition and complete (packaging, labels, etc.) so that they can be resold as new. They should, where possible, be accompanied by a copy of the proof of purchase, and must be sent to:
Mérigous
Alix D. Reynis
3 rue Marthe Dutheil

Article 9. – Complaints
Where applicable, the customer may submit any complaint by contacting the company using the following contact details: by email at help@alixdreynis.com or by post:
Alix D. Reynis
22 rue Jacob
75006 Paris

Article 10. – Warranties
In accordance with the law, the seller provides a legal warranty of conformity and a warranty against hidden defects for its products. The seller refunds the customer for products that are visibly defective or that do not correspond to the order placed. Refund requests must be made by email to: help@alixdreynis.com. Items returned by the Customer incomplete, damaged, deteriorated or soiled cannot be exchanged and will be handed back immediately or returned by post as soon as possible.
Article 11. – Intellectual property rights
The trademarks, domain names, products, images, videos, texts and, more generally, any information subject to intellectual property rights are and remain the exclusive property of the seller. No intellectual property rights are transferred under these General Terms and Conditions of Sale. Any full or partial reproduction, modification or use of these assets for any reason whatsoever is strictly prohibited.
Article 12. – Protection of personal data
In accordance with the French Data Protection Act (loi Informatique et Libertés) of January 6, 1978, you have the right to query, access, modify, object to and withdraw consent regarding your personal data. By accepting these General Terms and Conditions of Sale, you consent to our collecting and using this data for the performance of this contract. Article 13. – Force majeure
The performance by Alix D. Reynis of its obligations under these General Terms and Conditions of Sale will be suspended in the event of an unforeseeable event or force majeure that hinders or delays their performance.
Article 14. – Invalidity and amendment of the contract
If any provision of this contract is declared invalid, this shall not affect the validity of the other provisions, which shall remain in force between the parties. Any contractual amendment is valid only after written agreement signed by the parties.
Article 15. – Limitation of liability
Alix D. Reynis cannot be held liable for any damage resulting from use of the internet, including but not limited to data loss, intrusion, computer viruses, loss of connection, interruption of the internet network or other problems beyond its control. Alix D. Reynis reserves the right to suspend operation of the website at any time.
Article 16. – No waiver
The fact that Alix D. Reynis does not invoke any of the obligations set out in these General Terms and Conditions of Sale shall not be interpreted as a waiver of the obligation in question for the future.
Article 17. – Governing law
These General Terms and Conditions of Sale are governed by French law. Any dispute arising from the formation, interpretation or performance of these General Terms and Conditions of Sale shall fall under the exclusive jurisdiction of the French courts, notwithstanding multiple defendants or third-party claims.
The customer therefore declares that they have read all of these General Terms and Conditions of Sale and, where applicable, any Special Terms and Conditions of Sale relating to a product or service, and accepts them without restriction or reservation.
